By accessing or using our Site or making a purchase, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must stop using the Site.

1. Ownership of Content

The content on our Site, including but not limited to text, images, graphics, logos, and software, is the property of AURONIA or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may use the Site and its content only for personal, non-commercial purposes. Unauthorized use may violate these laws and result in termination of your access to the Site.

AURONIA and its associated logos are registered trademarks of AURONIA. These trademarks, along with any other trademarks, service marks, or logos appearing on our Site, whether owned by AURONIA or used under license from our partners, may not be copied, imitated, or used, in whole or in part, without the prior written permission of AURONIA or the applicable trademark holder. The use of any metatags or any other "hidden text" utilizing "AURONIA" or any other name, trademark, or product or service name of AURONIA without our prior written permission is strictly prohibited. All other trademarks, registered trademarks, product names, and logos displayed on the Site are the property of their respective owners.

Our website, www.auronia.com, and associated social media accounts include or may include in the future a product review feature, discussion forums, user-generated content areas, or other interactive services where you or third parties can create, post, or store content, messages, materials, or other items ("Interactive Areas"). You are solely responsible for your use of these Interactive Areas, and you use them at your own risk.

By using any Interactive Areas, you agree not to post, upload, transmit, distribute, store, create, or otherwise publish through our website or social media accounts any of the following:

Any message, data, information, text, music, sound, photos, video, graphics, code, or other material ("User Content") that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable;
User Content that would constitute, encourage, or provide instructions for a criminal offense, violate the rights of any party, or otherwise create liability or violate any local, state, national, or international law, including, without limitation, the regulations of the U.S. Securities and Exchange Commission or any rules of a securities exchange such as the New York Stock Exchange, the American Stock Exchange, or NASDAQ;
User Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party. By posting any User Content, you represent and warrant that you have the lawful right to distribute and reproduce such content;
User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity;

Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers;
Viruses, corrupted data, or other harmful, disruptive, or destructive files;
User Content that, in the sole judgment of AURONIA, is objectionable or restricts or inhibits any other person from using or enjoying the Interactive Areas or our website, or which may expose AURONIA or its users to any harm or liability of any type.

If you post User Content to our website, email User Content to AURONIA, or provide AURONIA permission to use, repost, or otherwise share User Content you have created or shared on social media, you grant AURONIA a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content throughout the world in any media. You also grant AURONIA and its sublicensees the right to use the name you submit in connection with such content, if they choose.

AURONIA disclaims any responsibility and assumes no liability for any User Content posted, stored, or uploaded by you or any third party, or for any loss or damage thereto. AURONIA is not liable for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography, or profanity that you may encounter due to User Content. Your use of the Interactive Areas is entirely at your own risk.

Although AURONIA has no obligation to monitor, screen, or edit any User Content posted in the Interactive Areas, AURONIA reserves the right, at its sole discretion, to remove, screen, or edit any User Content posted or stored on our website at any time and for any reason without notice. You are solely responsible for creating backup copies of and replacing any User Content you post or store on our website at your own cost and expense.

Any use of the Interactive Areas or other portions of our website in violation of the foregoing may result in, among other things, the termination or suspension of your rights to use the Interactive Areas and/or our website.

8. Information on Our Site

AURONIA is committed to providing current and accurate information on our website, as well as through email, chat, and telephone communications. However, we do not warrant that this information is always correct, accurate, or complete. In rare circumstances, data, including prices, may be inaccurately displayed on our Site due to system or typographical errors. Inadvertent errors or inaccurate advertised prices are not binding on AURONIA and may be adjusted by us at any time. AURONIA reserves the right to correct any and all errors when they do occur. If an order is placed with a product’s listed price lower than the actual price, AURONIA may, at its discretion, either advise the customer before shipping the product or cancel the order and notify the customer of such cancellation. We apologize for any inconvenience that this may cause.

The information provided on the Site is not a binding contract and should not be treated as such. If incorrect information is acted upon, the sole remedy available to the customer is to request the cancellation of the order placed as a result of this incorrect information. If an order has already been shipped, the customer agrees to either return the product for a full credit or pay the difference between the actual and charged prices. The stock availability on our website is listed "as is" and is subject to change. If a product in an order is out of stock, we will advise the customer immediately with possible options. Products may appear on the AURONIA website larger or smaller than their actual size. Due to variations in computer monitor settings, color and size may vary slightly when viewing product photography.

Our goal is to provide you with as much detail and information as possible about your prospective purchase so that you can see the beauty and shape of a particular item. In compliance with industry standards and FTC regulations, carat total weight may vary by 0.05 carats from the stated weight. We provide the measurement of our products based on our manufacturing specifications, with slight tolerances due to finishing during the manufacturing process. A width tolerance on machine-made wedding bands of 0.20mm is allowed, and cast-manufactured rings may vary slightly more.

For gemstone and pearl measurements, a tolerance of 0.25mm is allowed. For diamond jewelry set with multiple diamonds, we provide the minimum or an average total carat weight for the piece. Color and clarity grades are expressed as either a minimum or an average depending on the number of diamonds. If stated as a minimum, all diamonds within the piece are at or above the stated quality. If expressed as an average, collectively, the quality is equal to or exceeds the grade stated.

AURONIA retains the full, unrestricted rights to all jewelry designs, whether custom or standard, and may choose to market or sell jewelry based on such designs.

9. Diamond Certificates

When you purchase a ring with diamond from AURONIA, whether it is a natural or lab-grown diamond, you will receive a diamond grading report (also referred to as a diamond certificate) with your order.

These grading reports are comprehensive documents created by diamond grading experts at highly-respected laboratories, and they are costly to replace. Therefore, AURONIA requires that the original diamond grading report be included with any returned diamond ring. If you fail to include the diamond grading report with your return, you will be charged a replacement fee.

10. Pricing

Prices on our Site may occasionally be displayed inaccurately due to system or typographical errors. While we strive to prevent such errors, they may occur. We reserve the right to correct any and all errors when they do occur, and we do not honor inaccurate or erroneous prices. If a product’s listed price is lower than its actual price, we may, at our discretion, either contact you for instructions before shipping the product or cancel the order and notify you of such cancellation. If the order has been shipped, you agree to either return the product or pay the difference between the actual and charged prices. Prices are subject to change without notice. We do not negotiate prices on our products, and all our prices are final.

11. Order Approvals and Cancellations

All orders placed through the AURONIA website are subject to our acceptance and approval. An order is considered approved when you receive a confirmation email from AURONIA acknowledging that your order has been received and is being processed. This confirmation does not guarantee that your order will be completed, as AURONIA reserves the right to review and, if necessary, cancel any order at any time and for any reason.

AURONIA may choose not to complete or may cancel an order in its sole discretion, including but not limited to cases where:

The product is no longer available or is out of stock.
There are errors or inaccuracies in product descriptions or pricing.
Fraudulent or unauthorized transactions are suspected.
Payment information cannot be verified or is incomplete.
Any other circumstance that AURONIA deems appropriate for cancellation.

If your order is canceled after payment has been processed, AURONIA will issue a full refund to the original payment method. AURONIA shall not be liable for any damages or costs arising from any such refusal or cancellation of any order.

12. Payment Information

Payment can be made using credit cards through Adyen or via PayPal. By submitting your payment information, you authorize AURONIA to charge the amount of your order to your selected payment method. In the event of any pricing errors, we reserve the right to cancel your order and refund any payments made.

13. Shipping and Delivery

AURONIA offers free shipping on all orders within the United States. We make every effort to ship orders promptly, but delivery times may vary based on your location and other factors beyond our control. Risk of loss passes to you upon delivery of the products to the shipping address specified in your order.

14. Return and Exchange Policy

If you are not satisfied with your purchase, you may return or exchange the product within 30 days of shipment from our location, subject to our Return Policy. Products must be returned in their original, new and unused condition along with any accompanying documentation.

15. Disclaimer of Warranties

The Site and all products offered through the Site are provided on an “as is” and “as available” basis. AURONIA makes no warranties, express or implied, regarding the operation of the Site or the information, content, materials or products included on it. Without limiting the foregoing, AURONIA disclaims all warranties, whether expressed or implied, including, but not limited to, implied warranties of merchantability and/or fitness for a particular purpose, title, and non-infringement as to the information, content, and materials on the Site.

16. Limitation of Liability

In no event shall AURONIA, its directors, members, employees, affiliates, or agents, or any other party involved in creating, producing, or delivering the AURONIA products be liable to you or any third party for damages of any kind arising from the use of this site, including, but not limited to, direct, indirect, incidental, special, punitive, and consequential damages or other damages of any kind, including but not limited to loss of use, loss of profits, or loss of data, whether in contract, tort (including negligence), or otherwise, arising out of or in any way connected with or resulting from the use of our site, the products, the services, or the content contained in or accessed through the AURONIA site. This includes, but is not limited to, damages resulting from reliance by the user on any information obtained from AURONIA, any mistakes, omissions, interruptions, deletion of files or emails, errors, defects, viruses, delays in operation or transmission, or any failure of performance of the AURONIA site, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to AURONIA’s records, programs, or services, even if AURONIA has been expressly advised of the possibility of such damages.

In no event shall AURONIA’s liability exceed the price you paid for the product or service that is the basis for the claim.

You agree to indemnify and hold AURONIA, its affiliates, employees, and agents harmless from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Site or your violation of these Terms.

18. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Florida.

19. Severability

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable for any reason, such provision shall be deemed severable from these Terms and Conditions and shall not affect the validity or enforceability of the remaining provisions. The remaining provisions of these Terms and Conditions shall remain in full force and effect and shall be enforced to the greatest extent permitted by law.

Furthermore, if any portion of any provision is deemed invalid or unenforceable, the rest of the provision shall remain in effect and be enforced to the maximum extent allowed by law. The failure of AURONIA at any time to enforce any provision of these Terms and Conditions shall not be construed as a waiver of that provision or any other provision in the future. Any rights and obligations which by their nature extend beyond the termination or expiration of these Terms and Conditions shall survive such termination or expiration.

AURONIA reserves the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
